Dans un contexte marqué par l’intensification de la criminalité transnationale en Afrique de l’Ouest, l’entraide judiciaire pénale entre les États membres de la CEDEAO constitue un instrument privilégié de la répression pénale. Toutefois, sa mise en œuvre demeure centrée sur la poursuite des auteurs d’infractions, reléguant la victime à la marge du processus. Insuffisamment prises en compte dans leurs droits fondamentaux, les victimes subissent une véritable victimisation secondaire. La présente réflexion interroge dès lors la nécessité d’une réforme normative, aux plans communautaire et national, afin d’intégrer les droits des victimes dans les procédures d’entraide judiciaire, et propose une dynamisation de ces procédures en vue d’une prise en charge diligente des victimes. À la lumière du droit comparé, des réformes institutionnelles s’imposent : structures autonomes, renforcement des capacités des organes d’enquête, implication des juges nationaux et communautaires ainsi que des acteurs non étatiques. Ainsi, le système ouest-africain de justice pénale pourra s’arrimer aux standards internationaux et onusiens de protection des victimes.
