Num contexto marcado pela intensificação da criminalidade transnacional na África Ocidental, a assistência judiciária mútua em matéria penal entre os Estados-Membros da CEDEAO constitui um instrumento privilegiado para a repressão penal. Contudo, a sua implementação continua centrada no procedimento contra os autores das infrações, relegando a vítima para a margem do processo. Insuficientemente tidas em conta nos seus direitos fundamentais, as vítimas sofrem uma verdadeira vitimização secundária. A presente reflexão questiona, assim, a necessidade de uma reforma normativa, a nível comunitário e nacional, a fim de integrar os direitos das vítimas nos procedimentos de assistência judiciária, e propõe uma dinamização destes procedimentos com vista a um atendimento diligente das vítimas. À luz do direito comparado, impõem-se reformas institucionais: estruturas autónomas, reforço de capacidades dos órgãos de investigação, envolvimento dos juízes nacionais e comunitários, bem como de atores não estatais. Desta forma, o sistema de justiça penal da África Ocidental poderá alinhar-se com os padrões internacionais e da ONU de proteção das vítimas.
