W wielu krajach afrykańskich, gdzie ludność często jest w bardzo bezpośredni sposób uzależniona od zasobów naturalnych, ochrona środowiska konkuruje z rosnącymi potrzebami rozwojowymi wynikającymi z presji demograficznej. Konflikty zbrojne stanowią poważne wyzwanie dla ochrony przyrody i zasobów naturalnych w wielu regionach Afryki Subsaharyjskiej. Ponadto międzynarodowe prawo środowiskowe napotyka trudności w stosowaniu w niektórych państwach, zwłaszcza w Afryce, wynikające z braku wiedzy specjalistycznej w tej dziedzinie. Jeśli chodzi o odpowiedź prawa na wyzwanie, jakim jest degradacja środowiska w Afryce, pojawiło się coraz więcej aktów prawnych mających na celu walkę o ochronę przyrody i zasobów naturalnych oraz zabezpieczenie niektórych obszarów na szczeblu krajowym, jednak same działania krajowe nie są w stanie zapewnić ochrony środowiska. Stąd wynika konieczność współpracy regionalnej, która jest bardzo przydatna w promowaniu polityki integracji instytucjonalnej w dziedzinie środowiska naturalnego w Afryce.
