In diversi paesi africani, dove le popolazioni dipendono spesso in modo molto diretto dalle risorse naturali, la tutela dell’ambiente si trova in contrapposizione con le crescenti esigenze di sviluppo determinate dalla pressione demografica. I conflitti armati rappresentano una sfida di non poco conto per la conservazione della natura e la tutela delle risorse naturali in diverse regioni dell’Africa subsahariana. Inoltre, il diritto internazionale dell’ambiente incontra difficoltà di applicazione in alcuni Stati, in particolare in Africa, a causa della mancanza di competenze in materia. Per quanto riguarda la risposta del diritto alla sfida rappresentata dal deterioramento ambientale in Africa, si sono moltiplicati i testi legislativi volti a promuovere la conservazione della natura e la protezione delle risorse naturali, nonché a salvaguardare determinati siti o aree a livello nazionale; tuttavia, gli sforzi nazionali da soli non sono sufficienti a salvaguardare l’ambiente. Da qui deriva la necessità di una cooperazione regionale, che risulta molto utile nel promuovere la politica di integrazione istituzionale in materia ambientale per l’Africa.
