En este segundo tomo de su Curso de Filosofía del Derecho —destinado a la enseñanza universitaria—, el autor complementa la materia expuesta en el primer tomo con la teoría del Estado o sociedad civil, tratando de su condición de sociedad natural; de su causa final, el bien común; de cómo este tiene un carácter moral y objetivo, y debe ordenarse al fin último natural y sobrenatural del hombre. Se refuta la tesis de la neutralidad moral del Estado y se estudia la doctrina positivista de su origen meramente contractual. Luego se trata de la autoridad y su legitimidad; la tiranía y el derecho de rebelión. Se ven también las formas de gobierno, el carácter originario de la democracia, las relaciones entre el bien común y el bien particular, el orden internacional y las relaciones entre el Estado y la Iglesia. Al final de este libro se incluye un índice onomástico común para ambos tomos.
