GWB-Novelle geplanten Änderungen in § 20 GWB darstellen und die Gründe für die Änderungen aufzeigen. Anschließend sollen die geplanten Änderungen jeweils kritisch bewertet werden.Die 8. GWB-Novelle wurde am 18.10.2012 im Bundestag auf Basis des Regierungsentwurfs (BT-Drs. 17/9852) in der Fassung der Beschlussempfehlung des Ausschusses für Wirtschaft und Technologie (BT-Drs. 17/11053) verabschiedet. Ihr Inkrafttreten war ursprünglich für den 01.01.2013 geplant. Ziel der Bundesregierung ist die Modernisierung des deutschen Kartellrechts. Aufgrund von Streitigkeiten zwischen Bundestag und Bundesrat wurde am 23.11.2012 der Vermittlungsausschuss angerufen, der seine Beratungen auf Januar 2013 vertagt hat. Obwohl die vom Bundesrat beanstandeten Punkte nicht die Änderungen zur Missbrauchsaufsicht betreffen, hat die Verzögerung auch Auswirkungen auf § 20 GWB. Da die bisherigen Bestimmungen zur Missbrauchsauf-sicht (§§ 20 Abs. 3 S. 2, Abs. 4 S. 2 Nr. 1 und 3 GWB) bis zum 31.12.2012 befristet waren und deren von der Bundesregierung beabsichtige Verlängerung bis 2017 mit der nunmehr verschobenen Novelle vorgesehen war, sind die seit dem 22.12.2007 geltenden Ergänzungen dieser Normen bis zum Inkrafttreten der 8. GWB-Novelle vorläufig außer Kraft.
